Proponemos una teoría estética basada en un enhebrado cronotópico del discurso creativo que replantea las lógicas de constitución del sujeto. Tomamos como hilo conductor la película La voz de la luna (La voce della Luna, 1990) de Federico Fellini, cuyo surrealismo, lejos de suponer una construcción al azar de un relato, revela una sofisticada narrativa desde lo circunstancial (y no desde el sujeto o el objeto). Es aquí donde confluimos con las tesis más radicales de Antonin Artaud y su proyecto (...) político basado en el teatro de la crueldad y la reificación del fragmento-órgano. Concluimos con un alegato por una narración vital, que trascienda la obra, disipe la posición del sujeto en la misma (lo que Jacques Derrida denomina Forcener le subjectile) para que el sentido de la humanidad, en lo ínfimo y fragmentado, trasparezca. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. Both legal and moral theorists have offered broadly “communicative” theories of criminal and moral responsibility. According to such accounts, we can understand the nature of responsibility by appealing to the idea that responsibility practices are in some fundamental sense expressive, discursive, or communicative. In this essay, I consider a variety of issues in connections with this family of views, including its relationship to free will, the theory of exemptions, and potential alternatives to the communicative model. Focusing on Michael McKenna’s Conversation (...) and Responsibility, I argue that communicative accounts, and the conversational model in particular, direct our attention to important and under-appreciated elements of our responsibility practices. However, rather than focusing on a model of conversation-as-address, as McKenna does, we do better to regard gossip as the paradigmatic conversational form that captures the main features of moral responsibility. The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

Recent years have seen recurring episodes of tension between proponents of freedom of speech and advocates of the disenfranchised. Recent survey research attests to the ideological division in attitudes toward free speech, whereby conservatives report greater support for free speech than progressives do. Intrigued by the question of whether “canceling” is indeed a uniquely progressive tendency, we conducted a vignette-based experiment examining judgments of offensiveness among progressives and conservatives. Contrary to the dominant portrayal of progressives and conservatives, our study documented (...) ideological symmetry in their evaluations of offensive speech. When faced with utterances whose content matters to them, both conservatives and progressives viewed outgroup speakers as more offensive than ingroup speakers. A second contribution of this chapter is to provide a deeper understanding of the cognitive mechanism implicated in evaluating outgroup speech as more offensive than ingroup speech. Our results suggest that perception of offensiveness is mediated by ascriptions of intent: we tend to attribute negative intent to the speaker whenever we deem their utterances to be offensive, even against the explicitly stated speaker’s background attitudes. In the present contribution, we argue that all health care professionals and particularly psychotherapists should provide a plausible rationale for their treatment including an etiological model and a model of unique and common change mechanisms. The provision of a plausible rationale has two goals: (1) meet the ethical challenge of informed consent, and (2) to improve treatment outcome by fostering the meaning response. In the course of the ethical and a legal obligation of psychotherapists to obtain patients’ informed consent before (...) initiating psychotherapy, patients have the right to receive maximally comprehensive information for providing their consent, which - among other information about the treatment (such as general psychotherapeutic approach, setting, and procedures) – should include a plausible treatment rationale. A useful concept in conceptualizing and communicating a treatment rationale as part of the informed consent procedure is Moerman’s general notion of the meaning response as the physiological or psychological effects of meaning in the course and treatment of an illness. The more compelling the rational explanation of the targeted treatment effects, the stronger the meaning response is expected to be. As the mechanisms of change in psychotherapy are known to be quite abstract and considered common to all approaches to a large extent, it seems especially important to provide a convincing treatment rationale to strengthen trust in the therapist and potentially foster positive expectations of process and outcome. To that extent, strengthening a patient`s meaning response to information provided at the beginning of psychotherapy may be central to activating common therapeutic factors. (shrink)

According to a common belief concerning the Mach-Boltzmann debate on atoms, the new experiments performed in microphysics at the turn of the 19th and 20th centuries confirmed Boltzmann’s atomic hypothesis and disproved Mach’s anti-atomic view. This paper intends to show that this belief is partially unjustified. Mach’s view on atoms consists in fact of different kinds of arguments. While the new experiments in microphysics refute indeed his scientific arguments against the atomic hypothesis, his epistemological arguments are unaffected. In this regard, (...) Mach’s epistemological approach remains relevant for today’s discussion on the status of the notion of atom. (shrink)

In On the Difficulty of Living Together, Manuel Cruz launches a nuanced study of memory and forgetting, defining their forms and uses, political meanings, and social and historical implications. Memory is not an intrinsically positive phenomenon, he argues, but an impressionable and malleable one, used to advance a variety of agendas. Cruz focuses on five memory models: that which is inherently valuable, that which legitimizes the present, that which supports retributive justice, that which is essential to mourning, and that (...) which elicits renunciation or revelation. His methodical approach makes sense of memory's positive and negative effects, its contradictions, and its tensions. Cruz shows us that remembering is not necessarily an end in itself, nor is it a supreme value, immune to external influence. The exercise of memory guarantees nothing, though many insist it is a progressive act preventing the repetition of past mistakes. Tying the making of memory to the movements of history, Cruz prioritizes memory's political dimensions over its philosophical aspects and helps us remember its myriad uses. (shrink)

Interest in spirituality as a protective factor in various aspects of daily life has increased over the years. Still there has been relatively little research attention paid to the effect of spirituality in the workplace. The current study was conducted to explore the role of spiritual well-being as positive spillover effect on job satisfaction when adverse workplace experiences are reported. Spiritual well-being was related to job satisfaction even when the adverse workplace conditions of job frustration, work tension and victimization were (...) present. The context of the findings with other research and theory are discussed, as are directions for future research. (shrink)

Examino Acerca del cielo (De caelo) I 2 con el fin de mostrar allí la presencia de la demostración científica. Este desarrollo pretende aportar nueva evidencia en favor de la no discrepancia entre teoría y praxis científica en Aristóteles (Barnes, 1969) y de relativizar la interpretación de que el método real y únicamente usado es la dialéctica (cuyo antecedente se remonta a Owen, 1980). Además, siguiendo la propuesta hermenéutica de Gotthelf (1987) y Detel (1993 y 1997), mostraré de qué modo (...) se utiliza la demostración científica en la prueba de la existencia del cuerpo simple o éter. Ofreceré también una reconstrucción de las pruebas mediante la elaboración de un esquema que abarque el conjunto de las deducciones. Estos últimos desarrollos constituyen el aporte más novedoso del presente artículo. I examine On the Heavens (DC) 12 in order to show there the presence of scientific demonstration. This development tries to contribute new evidence in favor of the not discrepancy between theory and scientific practice in Aristotle (Barnes, 1969) and to make the interpretation that method real and solely used is dialectic relative (whose precedent goes back to Owen, 1980). In addition, following the hermeneutic proposal of Gotthelf (1987) and Detel (1993 and 1997), I will show how scientific demonstration is used in the proof of simple body (ether) existence. I will offer also a reconstruction of the proof by means of the elaboration of a scheme that includes the set of deductions. The latter developments constitute the most new contribution of the present paper. (shrink)

This article argues that Nietzsche’s transvaluation project refers not to a mere inversion or negation of a set of nihilism-prone, Judeo-Christian values but, instead, to a different conception of what a value is and how it functions. Traditional values function within a standard logical framework and claim legitimacy and “bindingness” based on exogenous authority with absolute extension. Nietzsche regards this framework as unnecessarily reductive in its attempted exclusion of contradiction and real opposition among competing values. I propose a nonstandard, dialetheic (...) model of valuation that requires a value to be both true and false as well as neither true nor false.In our Europe, life is no longer quite so uncertain, contingent, nonsensical. El ensayista Michel de Montaigne oficiará de guía en esa búsqueda. Él nos conducirá hacia el terreno en el cual la solidez de los fundamentos parece desvanecerse, o, más bien, hacia el momento simbólico en el cual una mera decisión humana, tan arbitraria como contingente, da origen a aquellas normas que poco a poco, gracias a esa maestra violenta y traidora que es la costumbre, habrán de ser veneradas en su aparente intemporalidad. The notion of law –as the notions of state or nation– is nothing but an entelechy that masks behind it a substantial absence. Its existence has no other purpose than to provide us with a symbolic support able to veil that originating void, making our world a place less hurried by uncertainty. In accordance with this, the aim of the present paper is to begin a search that may lead us back to the original soil, to the time zero of institution. The essayist Michel de Montaigne will be our guide. He will lead us to the land on which the strength of the foundation seems to vanish, or, rather, to the symbolic moment in which a mere humane, arbitrary and contingent decision gives rise to those standards who gradually, thanks to the violent and treacherous teacher who is custom, start to be worshiped in his apparent timelessness. En la conquista, colonización y evangelización de las Indias se dio una estrecha colaboración y alianza Iglesia-Estado, amalgama que reforzaba a ambas instituciones, aunque siempre bajo el control estatal, supervisada y coordinada por el Consejo de Indias. Las relaciones Iglesia-Estado en América pasaron por diversas modalidades: Patronato, Vicariato y Regalismo. En el siglo XVI rige el Patronato, basado en las concesiones Pontificias que ponía en manos de la Corona española el ‘cuidado’ sobre la Iglesia americana. Desde fines del XVI, religiosos (...) y juristas españoles elaboraron la teoría del Vicariato, según la cual los reyes, en virtud de la donación papal, eran Vicarios de la Santa Sede en las Indias y adquirían competencias en materia de disciplina eclesiástica. En el siglo XVIII el Regalismo asume ambas posiciones y las convierte en jurisdicción civil al considerar que los derechos esenciales del Patronato y el Vicariato no se basan en concesiones papales sino que son prerrogativas inherentes a la Corona, regalías o atributos del poder real. This article examines the Kantian thesis of the a priori nature of our knowledge of space. Because it makes the representation of objects possible as external to us and all others, and consequently, as distinct and individualized, space (whatever its structure may be) claims the status as necessary condition and as apriori possibility of all knowledge. However, in the light of various physical, psychological and philosophical considerations, it seems that the particular structure allocated by Kant to space (i.e. uniqueness, infinity, (...) continuity, homogeneity, isotropy, Euclidean character and three-dimensional character) is neither necessary nor a priori but is rather contingent and dependent on experience. For this reason a pragmatist relativization of the transcendental approach appears to be necessary: the structure of space which makes knowledge possible is not apriori in an absolute sense, but rather, it is determined within the context of a certain practice, which is characterized by a certain mode of interaction with the environment and reveals particular empirical constraints to which this spatial structure must fit. Few elements of Aristotle’s practical philosophy have been more discussed than the so-called “practical syllogism”. But there are also few as suggestive to the commentators as this one. In this article I intend to define what the theory of practical syllogism would consist in, as a separated element within the Aristotelian ethical theory (or, more precise-ly, within his theory of action). It is not properly a demonstration of the existence of such a theory, but rather of the possibility that it (...) can take its place, even a necessary one, into the Stagirite’s general theory of action, in spite of some difficulties that I try to solve. This book presents a unifying framework for using priority arguments to prove theorems in computability. Priority arguments provide the most powerful theorem-proving technique in the field, but most of the applications of this technique are ad hoc, masking the unifying principles used in the proofs. The proposed framework presented isolates many of these unifying combinatorial principles and uses them to give shorter and easier-to-follow proofs of computability-theoretic theorems.
